The Asylum and Immigration Tribunal have refused the appeal of a Bangladesh citizen seeking permission to visit family in the UK...RK ("purpose" of family visit) Bangladesh [2006] UKAIT 00045 (24 April 2006)
The UK Border Agency announced that they have secured a new contract with Reliance Secure Task Management who will be taking over the responsibility of escorting detainees in the UK and on removal flights when detainees are returned to their home country.
The company already manages a number of contracts for Her Majesty’s Prison Service. The UK Border Agency announced that this company known as Reliance will start their 4 year contract as of May 2011. Until that date, the current contracting company known as G4S will continue to be responsible for the management of escorting detainees as instructed by the UK Border Agency
 
Following the Spending Review announced today, the UK Border Agency has stated that securing border and migration control remains to be its priority.

In this Spending Review the government has planned to reduce the UK Border Agency’s budget by up to 20 percent over the next four years. It is claimed that the Agency will be made smaller yet also more efficient, and there will be a balance made between the funding used out of the taxpayer with the income of fees for applicants and visitors.

The UK Border Agency retains that whilst it shall continue to meet its international obligations, it will reduce the cost of asylum support and make more use of technology, focus more effort on the bigger risks and improve productivity.

Further to the UK Border Agency’s announcement on 9 September 2010 in relation to new increased immigration and nationality fees, the changed fees have now come into effect as of  1st October 2010.

Furthermore, the UK Border Agency has amended the following forms and guidance:

-NTL application form and guidance

-TOC application form and guidance

-Tier 5 (Temporary worker) application form

-PBS Dependant application form

-Tier 4 (Help text leaflet form) (G)
 

As of 1st October 2010, the amended guidance’s have been published by the UK Border Agency for sponsors and potential sponsors under Tiers 2, 4 and 5.

Please note that the only change to the Tier 4 (sponsor guidance) of the points-based system refers to an increase in the fee needed for a sponsorship action plan.



 

The current Tier 4 policy guidance states that students who wish to study with a new Tier 4 sponsor (before their visa expires) are required to be present in the UK when submitting a new application.

Reference is made to the following paragraph:

“277. If a student has entered the United Kingdom using his/her Tier 4 Visa, and the student wants to study with a new Tier 4 sponsor before that permission to stay has either expired or been curtailed, he/she must always make his/her new application from inside of the United Kingdom. If a student makes a new application from outside of the United Kingdom it will be refused.”

However, the UK Border Agency announced (on 16 September 2010) that they will be changing the above requirement and the policy guidance will be amended shortly to reflect the change.

Therefore, students with existing leave to remain in the UK will now be allowed to make applications from outside of the UK if they wish to do so. Previously, this would not have been allowed.
