Libyan visa holders – important advice
The UK Border Agency has advised all Libyans wishing to extend their leave in the UK under the Immigration Rules to apply in the normal procedure using the relevant application form. If an individual is unable to meet the requirements of the Immigration Rules or fail to provide the requested evidence, they must state their reasons for this and explain any exceptional circumstances. The UK Border Agency reiterate that applications for leave to remain will be considered on a case-by-case basis, however they also state that they may use their discretion when reviewing cases.
A Libyan national who has lawful leave or anyone who had previous lawful leave that expired since 22nd February 2011 and does not meet the requirements of the Immigration Rules but is unable to return to Libya may now be allowed to temporarily extend their stay in the UK. For such, an application should be made using FLR (O) application form. The UK Border Agency state that discretion may be applied in exceptional circumstances in order to grant a further period of leave for a period of up to 6 months outside the Immigration Rules. In normal circumstances, applicants using the FLR (O) form are required to pay the relevant fee, however the UK Border Agency have made provisions for Libyan nationals who are unable to pay the necessary application fee.
