If the applicant intends on coming to the UK for more than 6 months, he or she will be required to obtain an EEA family permit first.
Family members that are entitled to apply for an EEA Residence Card:
· Spouse of an EEA national
· Dependent child of an EEA national or spouse under 21 years of age (including step-children or adopted children)
· Dependant parents or grandparents and their spouse/civil partner of an EEA national or spouse (not students)
Applying
Applicants who wish to apply for a residence card must complete application form EEA2 which can be found on the UK Border Agency website. Residence cards are normally valid for five years.
Applicants must provide a valid passports and evidence that they are the family members of an EEA national. Documents supplied must be originals.
Indefinite Leave to Remain
Applicants may apply for indefinite leave to remain after having held an EEA Residence Card (or registration certificate), after five years of residence in the UK.
Refusals
Applicants may appeal against any refusal to grant them a residence document whether the application is made in-country or from abroad.
