Applicants who are not nationals of an EEA country or Switzerland, and who are in the United Kingdom with their family members who are nationals of Bulgaria, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia or Slovenia, will not be able to apply for a residence card until the national of that country has been continuously employed in the UK for 12 months.
The applicant can apply for a family member residence stamp instead to confirm their right of residence under European Union law. Therefore, only non EEA- national family members of persons required to register under the worker registration scheme may apply for a residence stamp.
Applying
The applicant must complete an FMRS form which can be found on the UK Border Agency website.
Documents required
The applicant must provide:
· A valid passport
· Evidence that he/she is the family member of an EEA national (i.e. birth or marriage certificate)
· Two identical colour passport sized photographs
· EEA family members worker registration card
· Family members wage slips/letter from employer/contract of employment
