Settlement Protection Rout ( Indefinite Leave to Remain)

Humanitarian protection holders and refugees with five years Limited Leave to Remain must apply for Indefinite Leave to Remain along with their dependents (if applicable) if their Leave is about to expire.

 

The UK Border Agency has announced on 2 August that refugees, those granted humanitarian protectionand their dependents who were permitted a five years Limited Leave to Remain, on August 2005 onwards, must apply for Indefinite Leave to Remain. This is because their Leave is due to expire starting from August 2010.

 

Making an application:

 

The application form that is needed to be completed by refugees and those granted humanitarian protection is the SET ( Protection Route) application.

 

Dependants:

 

To ensure that applicants’ Leave continues and that their cases get considered quickly, applications should be made in time. In the case of making a late application, applicants’ Leave will finish and the UK Border Agency will have to follow an in depth review of the case. However, this could lead to cancellation of the applicant’s status and perhaps their removal from the UK.

 

In addition to the essential requirement that the applicant MUST be in the UK when making an application, they should also list all of their dependents whom are living in the UK including those who were born in this country since their Leave to Remain was granted.

 

Fees:

 

Applicants will not be required to pay any fees as this application is free of charge. When making an application, applicants are advised to keep a copy of their immigration status documents for their own records.

 

It is recommended that applications, along with any other requested documents, are sent by registered post. Applicants will be sent acknowledgement letters as proof of receipt from the UK Border Agency once their applications are received.

 

In the case of having a successful application, Indefinite Leave to Remain of the applicant will be approved on a new status document.
