Further changes to Tier 4 and Tier 1 post study work categories

The post study work route which allows graduates to work in the UK following the completion of their degrees will be open until April 2012. It was previously rumoured that the post study work route might be closed this year however, the UK Border Agency have issued new policy guidance for applicants applying after 5th April 2011... changes to Tier 4

Visa application centre in Japan re-open
The UK Border Agency (UKBA) announced that the visa application centre re-opened on Wednesday 16th March 2011. The UKBA also acknowledged the difficulties faced by Japanese nationals who have not been able to leave the UK because of the recent natural disaster in Japan. They have been advised to keep proof of their original travel plans and to make arrangements to depart as soon as practicable.
 

Shortage Occupation list to be amended

The Government recently announced that it will remove eight occupations from the points based shortage occupation list.

The shortage occupation list contains jobs in the labour market which are not filled by resident workers in the UK. The Government is also removing 71 professions from the list of 192 professions under the Tier 1 category of the points based system.  The reason for this is because they are deemed to be below graduate level.  The new rules in April 2011 require anyone coming to the UK under Tier 2 to be doing jobs at or above graduate level. This announcement was made further to the MAC (Migration Advisory Committee) recommendations.

Immigration Minister Damian Green has confirmed that the recommendations are to be adopted in order for only skilled workers to come to the UK through the Tier 2 category. It is believed that under the new rules, 65% of those currently in the UK on the Tier 2 visa would not qualify.

On the 28th February 2011, the Immigration Minister Damian Green issued a Written Ministerial Statement proposing to increase immigration and nationality application fees for all applicant’s applying to study, visit, work or stay in the United Kingdom.Proposed fee increases   

Pakistan- Immigration Minister’s visit

Reports are claiming that the Immigration Minister Damian Green has, following his recent visit to Pakistan with Baroness Warsi, announced a new visa policy for Pakistan whereby visas will be granted within eight to ten days. Immigration Minister’s visit

Britain losing out due to complicated visa rules for Chinese nationals

It was recently reported in The Telegraph newspaper that those visiting the UK from China face higher fees and longer waiting procedures to obtain a visa compared to other European Countries. As a result, Chinese nationals are opting to travel to alternative cities in Europe which a means a loss for UK retailers.

Chinese tourists have surpassed Japanese tourists in their spending and according to a financial services company; they are worth over £350 million to UK retailers.

Chinese nationals have complained that the forms to obtain visas for the UK are too long in comparison to their European counterparts and that, shorter visas to the UK are substantially more expensive than longer visas to other Countries (notably the Schengen visa). Chinese tour operators are said to be referring nationals

Leading retailers such as Selfridges and Harrods are campaigning for the rules to be relaxed for the 2012 Olympics.

Despite this, the UK Border Agency has declared that there has been a 42 % increase in the demand of visas from China.

Worker Registration Scheme to close

Immigration Minister Damian Green declared, on 10th March 2011, that the Worker Registration Scheme will be closed as of 30th April 2011.

This scheme was introduced in 2004 after the entry of the eight additional countries, known as A8, to the EU.

These countries were:

  • Czech Republic
  • Estonia
  • Hungary
  • Latvia
  • Lithuania
  • Poland
  • Slovakia
  • Slovenia

    Currently, any national of one of the above countries is required to register under the scheme before commencing employment in the United Kingdom. The scheme was set up for monitoring purposes and UK Border Agency figures show that between May 2004 and end of 2010 an estimate of 1.1 million of A8 nationals registered under the scheme.

    Due to the fact that the Treaty of Accession prohibits the UK from applying transitional restrictions on A8 national’s access to the labour market for more than 7 years, as of 1st May 2011, A8 nationals will be able to access the labour market like other EU nationals. Furthermore, A8 job-seekers will be able to enjoy similar entitlement to that of out-of-work benefits as other EU Nationals.
